Court rules against Network Rail in court case about encroachment of Japanese knotweed

Landowners will be able to claim damages if the “pernicious” Japanese knotweed has encroached on their property, after a court of appeal ruling.

In a decision that could have implications for landowners across England and Wales, three judges ruled in favour of two householders whose properties had been affected by the hazardous plant.

I wonder if this will support NR's tendency towards more aggressive rail-side vegetation management.

it grows on the line behind my house. before the initial case it would take NR ages to deal with it, however, since the ruling it takes a week.

Great news

Just heard the story on the R4 news.  It has implications for all landowners.  One of my neighbours had to spend a fortune eradicating Japanese Knotweed from her property which came from the garden next door.  The absentee landlord owner (of the next door property) did absolutely bugger all about it so she ended up footling the bill and having to take her property off the market until it was sorted so the judgement has a big thumbs up from me.

Thames Water might get their finger out a bit quicker after this as well. 

With regard to NR policy, I can’t see how they can conflate tree-felling with dealing with this weed. However, I’m sure they’ll probably have a good try. 

That's rather what worries me.

No point dealing with it by cutting it down. A tiny bit of the root can regenerate it.  I suspect the only thing that works is a succession of treatments with the hated glyphosate, which does eventaully get down to the roots.
