Harringay, Haringey - So Good they Spelt it Twice!

I am facing being served with a section 21 eviction. From what I understand the process takes about 4 months from the notice being served. I am hoping to put in a defence claim and a counterclaim and delay the eviction further as I do not have the means to move right now.

Someone told me that in Haringey there are further delays in getting court dates and the whole process may take 6 months instead of the normal 4... is there any truth to this? Does anyone tenant or landlord have recent experience of being evicted in haringey and how long it took?

Take a look at Shelter's resources on eviction - there's also a helpline. Haringey Council also offer helpIf you are a council tenant, ask to be referred by your rent officer to the housing project based at Haringey Citizen's Advice. If private, Shelter are good. Above all don't panic - section 21 notices are the beginning not the end of the process. 

We are private, renting from family. I have spoken to Shelter and they told me I need specialist legal advice. Shelter give great advice, but its very general. I was hoping to find out how long it takes specifically in the haringey courts...

The Haringey Law Centre covers housing. Your other option is to go to Haringey CAB. They have lists of solicitors who cover housing that you can get from reception.

on another note any idea on how long the housing waiting list is in haringey? Will the council help us with a deposit or housing benefit if we are forced out?

Hi if you haven't already, have a look at the Section 21 Act . It helpfully sets out the steps which need to be taken which can help to mitigate an eviction. See where you are in the steps and whether there's scope for a reprieve /appeal.

So 4 months total? From the date of the notice coming through the door? Even if we have a counterclaim?

They are foreign landlords. They simply want to sell for profit. We are not in any arrears.

The owners of a house are perfectly within their rights to take back a house which belongs to them I'm afraid, even is the tenant has done nothing wrong. Presumably, you paid a deposit [pdf] and will get that back at the end of the tenancy, assuming you paid it after 2007, and it should be in a tenancy deposit scheme - ask your landlord which one they use.

If you sit tight until the eviction, you will be classed as homeless by Haringey Council and, depending on your circumstances, you may be able to get help, look at the this page on eviction and contact them directly now - Housing Advice and Options Duty Line on 020 8489 1000 Eligibility for housing benefit is based on your income and residency status and if you were able to get it, you would probably already be claiming it. 

Without paperwork and a detailed knowledge of your circumstances (which I would urge you not to share online), it is hard to offer more detailed advice and if Shelter have said you need specialist legal advice then I think that is the road you need to go down. Alternatively, you can speak to Haringey council to see if you are eligible for any of these things
