Harringay, Haringey - So Good they Spelt it Twice!

I am trying to claim compensation for a serious assault and I'm entitled to gov.uk CICA .

Can anyone advise me on who to claim with other than c i c a and if I can put other applications to different companies and then choose one.

I have presented them with an application however I'm not happy with it because that is no sections for your mental trauma when I call them Mr up I was told to put in another separate claim.

Advised I received on the phone call was basically my questions where answered as briefly and as little as possible in the most educated way,

It sounds like you need some proper legal advice. Ring a few solicitors. Remember the 'no-win, no-fee' firms will take a very large proportion of whatever you get.

You could consider an online chat  with Citizens Advice. And on their website there's also lots advice and help

Citizens Advice Bureau is your best bet.

I've had dealings with CICA. You will probably need a police crime number to start with, (the first C in CICA being 'criminal'). And it takes time and patience.

They will want to access any medical records relating to the assault, (this is where the doctor could emphasize your 'mental trauma.' ) They will be very thorough in gathering all the details they will need to process your claim. And think what it is you are actually claiming for? Loss of earnings? (you'll have to prove that.) Physical scarring or disability? Life changing results of the incident? 

I wouldn't recommend an independent solicitor as they would need someone to actually claim against, preferably someone who's insured, and then they'd want a cut.

CICA is for when there is no-one to claim against so a solicitor would only be able to charge you for filling in the CICA forms for you, a waste of money when you can do it yourself.

I think it took a couple of years for our claim to go through although we did get an interim payment halfway through. We just carried on with our newly adjusted lives with the occasional Q&A from CICA.

Then we got the final payment which was mostly based on loss of earnings (had to take early medical retirement) backed up in our case of over 30 years of old pay slips! (That surprised them)

It was worth waiting for.

Sorry for taking a long time to respond your answer is the only answer that has literally helped me it bugs me when NH I receive replies that are all the most obvious answers to my question thank you very much for your appliance may I ask you c i c a gov.uk how to operate and I am getting firms calling me ME8 that will take my my case on behalf of gov.uk when explained I was told CICA gov.uk request you to do all the running about and cover all the forms I don't mind doing that then I was told I will only get minimum amount and was also told there's a possibility that I could lose the case if I don't go with a c i c a third party to represent me on the other hand and when doing research I found out yes it's true I have to run about and supply all the evidence as said that's not a problem but what I don't know is is if the awards are the same amount as having a third party because if it is is I don't see the point involving a third party I have no reason or doubts I have a winning case I was seriously assaulted for no reason and it up with broken jaw still ongoing treatment due to the extent of damage everything has been done legally so I was worried about giving police reports hospital reports e.t.c. I just don't know where to start as I'm having so many cores who want to take on my case but then when you look at a private firm that offers go into the hundreds of thousands and obviously you pay a high amount when you win but when applying to gov.uk you are only allowed to put down five injuries and I have more than that when I spoke to them said I have to do another claim.

When I spoke to a third party that works on behalf of gov.uk that takes a no win no fee basis is the amount that was offered for my broken jaw was ridiculous after everything I have been through and the problem is is due to covid long of getting help for ongoing issues although I have been diagnosed with other issues due to the assault I have not received any treatment and I was wondering if this would affect the payout and also no I am not not not are the surgeons or doctors sure when treatment will stop it's just so complicated but your advice really helped thank you so much if possible can you inbox me and let me know who you claimed with thank you

What do you mean by no claim against you I don't quite understand .

I was severely assaulted in the street the person is now in prison sentenced to 8 years without parole and when released on an extended licence for 4 years that's how serious my injuries were and are ongoing.

So do I just apply to the victim compensation gov.uk or do I go to to the CIC a gov.uk with a representative example Winston c i c a I know they are a firm but they work with gov.uk.

That's what I can't understand and when you phone them obviously they make you believe that if you go with gov.uk only without a representative you could lose your case and they give you a less payout where is if you go for a firm that works with gov UK CICA you get what you are entitled to at the maximum amount and just pay the winning the at 25% and if if your case has been declined they will fight it for you and they stated if I just go with gov.uk without a representative and my case has been declined I will not be able to put in another claim

Only reason why a claim can get refused would be because of a criminal record

Are you in a union which provides legal advice to members? Some home insurance coverage also provides this?

Who exactly is this third party that you would be claiming from? Have they got the money to be able to pay up?

So  as I have been explained that's why I'm confused. CICA gov.uk they don't provide legal help so for example express solicitors CICA compansation  act as a third party with legal add and work on a no win no fee..

That's what I have been lead to believe.

Where as CICA gov.uk you apply I'm not sure if they take a winning fee that's why I'm confused .

CICA is from  public money. They don't try and get your award from anyone else.

A solicitor would probably be trying to sue your actual attacker. If they've got no money, you won't win a lot. And then what would the fee be?

The forms for CICA are simple to fill in you don't need a solicitor for that. He'll just take a percentage of any award that you do get.

You say that you suffered multiple injuries and that CICA only allow five for one claim? Do remember that they will understand what impact this assault has had on your life,  the ongoing treatment and problems that causes and take that into consideration. They will be looking at loss of earnings at the time and any expected life changes in the future for this to base your award on.
