There is such a board fixed permanently to the upper level of the terraced house next to mine. It has been there well over a year despite (usual) full occupancy of the four units inside. We complained to the council and their eventual reponse was that although there was a breach of the regulations, they would be using their discretion not to take any action because the breach was of a minor nature. Naturally I take a different view.
The council states that "planning enforcement is a discretionary function". That raises the question of whether the council could ever be compelled to take such an issue seriously - and also what the point of the relevant regulations is.
Can anyone advise or assist?
