Harringay, Haringey - So Good they Spelt it Twice!

There is such a board fixed permanently to the upper level of the terraced house next to mine. It has been there well over a year despite (usual) full occupancy of the four units inside. We complained to the council and their eventual reponse was that although there was a breach of the regulations, they would be using their discretion not to take any action because the breach was of a minor nature. Naturally I take a different view.

The council states that "planning enforcement is a discretionary function". That raises the question of whether the council could ever be compelled to take such an issue seriously - and also what the point of the relevant regulations is.

Can anyone advise or assist?

Did you get their name? That is an outrageous thing to say but I was at an area assembly about a year ago when Nilgun Canver said basically the same thing and was brought to task beautifully by Rachel Fisher.

We deserve the same respect from the council and its employees as people who live in Highgate.
This was in a letter!

we cannot generally be bothered about enforcement - same attitude pervades all of society. one rushes to make a sensible rule/law and then one doesn't make sure it is obeyed.
I have been promised in writing a seven day action for three neighbourhood complaints - its three months and several reminders later and still nothing has been done.
walk the borough's side streets and you are bound to find untaxed vehicles on the road - police tell the local authority and the incidents continue.
overgrown hedges reduce pavement width and hide street names - action? nothing
makes a mockery of legislation and the enforcers complain that we do not comply.
the excuse is nearly always 'resources' - adequate sums are hardly ever put aside to enforce
may I suggest that the real reason is apathy and poor management.
why do we pay council staff? why do we elect councillors?
middle management should be held responsible and made to pay for mismanagement
will someone keep a list of poor decisions and we can use them at next election time
I heard this week that Neighbourhood Management as a department may be 'downsized' or 'lost' forever.
What next?
I had the same problem in Umfreville road and complained to no avail so I just took them down in the night, cut them up and posted them back to the agents in question, after about 20 boards they got fed up and stopped putting them up... probably illegal but it made me feel better....

As a group of neighbors might I suggest that you get a ladder and pull the board down yourselves. It's very effective!
Yes, we have had a few different tenants in the upstairs flat above ours and usually end up pulling the board down ourselves - we don't want to act as advertising for the agency! You are then left with the problem of getting rid of the board though. Maybe we should take them back to the agency en mass?
Thanks guys, but it's not on my property, it's on theirs, and it's their property (the sign) so I have no right to touch it. If I did, it would have been down long ago...
It dosnt dosn't matter that the board is not on your property, you will not get into trouble-whos going to bother to report it? and to whom? when they are breaking advertising laws. Like I said we've pulled them down many time from the house next to ours [after several calls complaining to the council and the estate agents] Normally after a boozy Friday night as a bit of Dutch courage doe the trick! If not graffiti it, at least this gives the whole street a laugh at the estate agents expense!

The favourite one I saw was over Christmas a year or so ago when someone posted an entire paul simons board (with wooden post) through their letter box. It was hanging out the letter box right through until the New Year...

On the legality side, if you're in a leasehold property there may be a clause in the lease which prohibits signs being attached without the consent of both leaseholders. I don't see how anyone can argue if you remove the sign in that case, and indeed I've done that myself and sawn up the sign afterwards. In general, as Vix says, who are they going to complain to?
