Harringay, Haringey - So Good they Spelt it Twice!

I have been keeping an eye on tinterweb and the FOFP website but can find no information on what happened in Court yesterday with their legal challenge against the Wireless Festival.  Does anyone know what happened?

What they actually mean is they will apply for *permission* to appeal. You can't appeal without permission.

Wireless is probably safe I'd guess.
When and how can we see the transcript of the proceedings?
Unlikely ever. I doubt that either party paid for transcripts and the court won't transcribe automatically. If the Judge gave an oral Judgment on the day there may not even be a written Judgement.
If they're seeking permission to appeal from the Court of Appeal, they will need a transcript of the judgment itself, which they will have to pay for, unless the judge ordered otherwise (possible here because it is an environmental claim, to which specific principles on costs apply). Once this happens (which usually takes weeks, if not months) it should be available here: http://www.bailii.org/recent-accessions.html#ew/cases/EWHC/Admin

My last high court case was unreported and no written Judgment was ever made. If you missed the Judge giving oral Judgment on the day, that was it!

Having said that, if the Friends do appeal they will have to pay for the court transcript of the Judgment so something may pop up later.

The report in the Evening Standard quotes Tom Palin thus: 

“We are considering today’s judgment and will be issuing a statement tomorrow which will outline our plans to appeal this decision.”

Clive Carter unusually hasn't posted on HoL on any subject for just over a month, though he is tweeting. He may be leaving FoFP comment to the likes of Tom Palin.

Because of the nature of the claim, specific costs rules apply, such that the maximum costs risk to FOFP is £10,000. I would expect the Council's real costs are already significantly higher.
