Harringay, Haringey - So Good they Spelt it Twice!

The following is from Rightmove.co.uk but the sale is being handled by Keatons.

Ben, look for a house with a really ugly yellow door...
It's no. 12. I've already raised this with David Lammy's office and ward councillors. The house in question was illegally converted as an HMO some years ago and the owner had to be taken to court to force him to return it to a single family dwelling. Works were carried out all last summer but suddenly stopped.

It looks like he is trying it on again. Have a look at the floor plan on the Keaton's website (link below). The rooms are subdivided and incredibly small. The living room (which is a tiny part of the kitchen at the back) has a toilet opening directly into it. As well as getting enforcement involved I've also asked for building control officers to visit as I'm sure the way it has been done contravenes building regulations.

Thanks Michael. If he's doing this in breach of a court order then he's very naughty indeed. We need a solicitor to advise on the fastest way to get the matter back into court! Any solicitors reading this please step forward . . . . . . . .
This is disgusting. This is exactly the kind of case we need to make an example of and put other landlords off. Has anyone been on to planning enforcement yet?
How about arranging some visits as prospective buyers and taking a camera, would this be useful?
There was an application for a certificate of lawfulness for 4 bedsits in late 2007 which was rejected:

I've attached some of the case documents. Try matching the plans against the 'Keaton's seven' plans for fun. It concerns me that the presumed recommendation was to grant the application, or did I misunderstand the report?

The decision was for refusal of a lawful development certficate. The crucial text being "Therefore the flats are deemed NOT LAWFUL in the application received on 18/09/2007 (drawing number/s 12WR/02 & 12WR/01., if applicable), and planning permission is required." Don't know if he tried submitting an application but whatever the court judgement was clearly to return the property to a single family dwelling.
Has anyone reported this to Patrick Sullivan / planning enforcement? There should have been a court order on this property to restrore it to it's original state. I wonder why this has not been done / been followed up. Ben, any idea?
Does anyone know how this works when a new owner takes over?
The enforcement applies to the property no matter who owns it (as in the case of my house) but the estate agents only mention such info as an afterthought and often with a wink that you don't have to worry about it too much. Isn't it time estate agents were tackled over their willingness to collude in this illegal activity?

The councillors have been informed and are following it up with enforcement.
Is that right, that estage agents would just turn a blind eye, even when it is quite this blatent?? I was obviously being naive in wondering whether having a word with Keatons might end up with it being struck off their books ..! Amazing that they would be quite this unscrupulous given the circumstances with this property.

There's another estate agent culled from my ever-dwindling list of people I'd contemplate using in the future!! (Actually, I think I was to zero already ... )
Well in the case of my own house, Paul Simon (of course) advertised it as 2 flats and had in the blurb that it would make a good "investment" even though they knew full well that it had an order against it and got round to mentioning it when we went for the viewing. (It meant for us that we could knock the seller price down quite a lot)

However, there would have been nothing to stop us from leaving it as it was.

The estate agents don't give a damn about the area or what they collude in. They feed off communities with their illegal boards up everywhere and their tacit support of these illegal activities. It's all just property and punters to them.
I think a letter to Nilgun Canver about this is the way to go, the HMO working group and all that. We need an example, and we need media attention to send a strong signal to landlords as well as estate agents that this is not acceptable, and they can't get away with it.
