A few cars, vans and ambulances have been slip-sliding up Cavendish Road today, so I was curious to see how a Jewson lorry would fare.
Answer: Just go extra fast. Really attack those speed bumps that are for vehicles up to 7.5 tonnes. How lovely of them.
I ve just used Jewson's website to complain about the lorries going up Cavendish Road. Our whole house shakes when the lorries bang up & down over the speed bumps.
I think the council should either enforce the 7.5 tonne restriction or remove the speed bumps !
The Council has (according to Jewson's) reassured them that they are in the right, and can carry on as they have been. This is incorrect, but from my discussion with the council officer (see above) they seem to have interpreted the relevant Ordinance in a crazy way, such that the whole area bounded by Wightman, Green Lanes, Turnpike Lane and Endymion Road counts as one "street" (despite the Ordinance referring to multiple streets) such that anyone who needs access to any street in that area can drive down any other street in that area, whenever they want, no matter what the weight of their vehicle. I explained to the Council officer why that interpretation wasn't remotely plausible on the text of the ordinance, and he seemed to take the point but said it wasn't something he could make an 'executive decision' on - so he referred it up the tree. And was never heard from again...
I dont really understand the response from the council
"The only way we can enforce weight restrictions is to follow a vehicle through the zone by car because we have to prove that the vehicle is not using the road to make a delivery to a property within that zone."
Surely if a council official / policeman witnesses an illegal vehicle in the zone or someone takes a photo of an illegal vehicle, they can contact Jewsons ( or which ever company is involved ) and ask them to prove they were making a delivery ratehr than just using as access.
Yup. Every delivery comes with a paper trail. The burden of proof should be on the delivery company to show they were making a valid delivery.
The problem with Jewson's is not just proof - the Council seem to have given them a blank cheque to go wherever they want, even if they're not making a delivery, based on a strained interpretation of the relevant Ordinance.
Hi Malcom - Where canI find the relevant ordinance ( sorry I 'm new to this having only moved to the ladder in Oct.).
How can it be legal when the road sign says no access to vehicles over 7.5ton ?. Can the council decide this does n't apply to specific companies ?
Are the lorries able to use Endymion road or is that too restricted ?
The ordinance is here.
time to re-educate the council.
Jewson have stated on here that they DO use Burgoyne and Cavendish for access and that they're allowed to. No investigation or following with cars is required. They are clearly breaking the law, in front of our eyes and in front of the council and the police. The law is useless without coercion and coercion is supposedly provided by the police and the council. I have no idea what it would take to cause a policeman to not enforce the law but the council are obviously very sympathetic with local businesses, if they threaten to leave they will be taken seriously.
There is no way you are going to be able to do anything with this other than individually threaten the drivers with the £1000 fine (breaking this law is punishable by a £1000 fine to the driver and the employer). Nobody with the power to do something about this wants to because it will severely hurt Jewson's business. It's the same deal with OnTime and Veolia at the top of the Ladder.
Nirvana would be width restrictions at either end of Wightman Rd which would also legally allow Jewson to use any ladder road for access but would reduce the 90% of ladder HGV traffic which is either entering or exiting via Wightman Rd.
I suggest that we draft a letter that we can each send into the council. I can have a go at it later on this week, and will send it to anyone who wants by PM.
My husband and I have always said we'd be happy to have lorries using our road so long as they drive sensibly- the problem is, they go very fast down the hill, and then when they hit the speed humps it causes the houses to shake like there's an earthquake going on.
It isn't a problem limited to Veolia either - as John points out, there are lots of HGVs whose satnavs point them down other roads in Green Lanes.
And we all have to face the fact that the council doesn't have the money, or the political will to enforce this - so as a compromise i'd suggest removing the speed humps, and putting up speed restrictions.

That link shows that Jewson have thought better of their foray into social media and deleted their account. Along with that deletion goes the admission that they use Burgoyne and Cavendish for access. Is Rebecca Wade not also going to jail for attempting to delete evidence like this?
All for some people power, but might be better if we start with a petition, maybe get a letter writing campaign going, posters, leaflets, etc .
I'm new to the ladder so not sure what has already been done on this front ?
