Illegal Conversions at 69 Effingham / 82 Warham / 69 Roseberry Gardens

The application for a certificate of lawfulness for the illegal conversion at 69 Effingham Road has been rejected again. A full copy of the officer's report can be found here.
Planning expect it to be appealed (although given the evidence from both neighbours and the estate agent who sold it saying that it wasn't two separate flats, let's hope this one doesn't get away with it). You may also be interested to know that the same applicant is currently subject to two revocation actions in relation to previous applications for a Certificate of Lawfulness which were granted on what turned out to be false evidence. One is for 82 Warham Road, the other for 69 Roseberry Gardens.

I wonder what happens (if anything) to the person who supplied a false statutory declaration in favour of the owner - is it classified as perjury?
Possibly, although I'm not sure if they've actually got to stand up in court (rather than just make a stat dec) before it's perjury. Not relevant here as the stat decs submitted were (apart from one) not genuine stat decs (i.e. they weren't real but factually incorrect ones, but rather just cut and paste jobs from other stat decs. Which is why 'copies' rather than original stat decs are often used in fraudulent applications).

Especially pleasing as an example of how a group of interested and committed people, sharing tasks, can dig out the facts, make a case, and get the right decision.

Can I make clear that although the officer's report mentions my name, this is mainly because my signature went on the formal objection. In fact, lots of us have worked on this - not all of whom want to be named. Investigating this and other applications has been a slog by many people, including trips to the Planning Office, web searches; contacting witnesses etc,

It's also good to report that following a meeting with Cllr Claire Kober and the Director of Urban Environment (arranged by Nora through David Lammy's office) the whole procedure for assessing Certificates Of Lawfulness has been tightened-up. (Although not yet as much as we wanted.) There's a very real chance of Haringey being a trailblazer on this issue.

Meanwhile work goes on with other properties. From cases we've seen - not just this one - we all learned a huge amount about how some applicants 'game' the system. As HoL reaches well beyond the borough, I'd invite any other residents' groups tackling these issues to get in touch so we can pool our knowledge.
