I don't get it.
From the Haringey planning page it seems they put an application to convert a travel agents into a coffee shop and install a new extractor flue in the private yard at the back. The application is refused. So what do they do? Convert the travel agent AND the rear yard into a restaurant complete with seats, tables and (natch) smoking in the rear yard.
Anyone know what is going on here?...

The planning enforcement covering the extension has not been served as yet... Only a notice covering opening hours and the extraction system has been served. They have till the 27th September to respond to that one.
Speaking to the Service Manager (and Lorcan Lynch's boss) - Mr Malcolm (0208) 4895520 he said that the notice covering the extensions or canopies in their phraseology is yet to be served and there is a process they must go through and they want to make sure that they don't get it wrong and bring legal costs against the council. Apparently this will be served sometime after Lorcan returns from holiday on the 26th September.
I would think given the current delays this won't happen to October.
He also managers the licensing area and said that no evidence was produced to show Sandero offering any nuisance and thus the license was granted. The council clearly doesn't think 10 letters are strong enough evidence of this. However there are many conditions to the license such as the extraction system, fire regulations and a variety of conditions governing the outside area.
Crucially they will not be allowed to play music or allow anyone in the outside area after 10.30pm at night. However more importantly, the line about ‘meeting the plans submitted’ apparently does not refer to the original plans submitted to planning, but the new plans submitted only for the alcohol and music license, however these match the original plans which does not show the extensions. A copy of which can be seen here. 3rd link down ‘Agenda reports pack’, page 160.
So, if I read the license correctly they will only be able to serve alcohol inside as it was not included in the plans. However, the license does mention the outside space and granting it a license, which is at odds with the plans submitted. So I will be following this up with the council.

Not only that, but of course we now have the hideous "skylights / vents"... and hang on - do they not need permission to put those signs out on the pavement? They must do!
If anyone knows the answer on that one please let me know - or perhaps I should raise it myself with Mr Lynch...

Well done for getting hold of someone in planning Katy. I've had no luck on that score since Lorcan went away. Disappointed to hear that the notice hasn't been issued yet but at least they're still issuing it.
Re. the plans submitted on the licence - I spoke to licensing about this. They said the plans can just be resubmitted at any time by the restaurant so it won't cause a problem for them. I guess the restaurant is in breach of licensing conditions whilst inaccurate plans are registered with the licensing people at the council (as they currently are) but it the matter ever came to a head, Sandero could just resubmit accurate plans.
This seems to make the plans that the licensing people hold rather redundant but I'm sure there's some convoluted bureaucratic reason behind them. If anyone knows anything about this, I'd be extremely pleased to be contradicted.
The other conditions on the licence are indeed valid though and we should report breaches as and when they happen (like the fact that the outside area still never gets cleared before 23:00).
On two particular points which concern me the most:
1. The noise team said that Sandero had agreed not to play music in the outside area. They also say that only background music can be played in the outside area. This is obviously contradictory and I'd like to know whether the playing of ANY music outside constitutes a breach of the licence as a result. I hope it does. I'm waiting to hear from licensing on this but it's really a legal question. Anyone know any "licensing lawyers"?
2. The noise team also say no music played at Sandero should be audible at or within the site boundary of any neighbouring property. If this were upheld in full I would be extremely happy. Perhaps if we report to the licensing people whenever we hear music from Sandero in our houses, we will see how effective this condition is. Again, advice from an appropriate lawyer would be useful.
On planning, I guess we will have to wait and see.

Another condition is waste management. They currently have a bin located in the residential property opposite. If this bin is overflowing and therefore not shut or there are bags on the floor next to it then this is an issue for the council environmental dept and complaints should be made to them. Apparently based on complaints they have been fined twice so far. Did anyone else notice the very large meat bones half way up the street this week. I wouldn't mind the resturant if they respected their residential neighbours but they have completely disregarded planning and licencing so far so it doesn't bode well so far.

I saw what looked like a discarded lamb bone. About a third of the way up the street lying in the road..

Just a thought (bearing in mind that I'm not directly affected by this particular restaurant, but it irks me to see any business causing trouble for residents) - has anyone checked whether they have a PRS licence for playing whatever music they are playing?

I'm sure they don't have a PRS licence. They built the restaurant without planning permission or a licence so I'm sure they wouldn't have bothered with a PRS. Not sure whether that just means a fine or whether it's actually a way to permanently stop them making noise outside which is really what we're looking for. I'll look into it. Thanks Bethany

Ita all gone very quiet on the Sandero front here, does anyone know what is going on re planning enforcement, I've not had any emails from them.

Yea - pneumatic drills and skips of building waste - looks like fairly major work in there but I don't know anything new. Time we heard from planning I think.

Is anyone else having trouble getting planning updates from the council? I can't really call in the day and my emails are being routinely ignored. I'm starting to get slightly suspicious. Don't know exactly what I'm suspicious about but it seems like the council have gone from being extremely helpful and forthcoming with information as they were 4 months go- to being cagey and secretive. This is probably paranoia bread from frustration. Anyone else any luck?
