How long does a tree have to be missing for?

I 'adopted' a tree outside my house when it was planted as a sapling. I chased off the young kids trying to see if they were strong enough to pull it up and watered it during dry spells. I enjoyed watching it grow and in time the birds that it attracted and the bright flower then orange berries that it produced. But my neighbours didn't. Other trees in the street, planted at the same time, disappeared, by what methods I don't know except that one woman was going on about copper nails. My closest neighbour complained about bird poo and enlisted the help of another close neighbour to destroy the tree and knock it down. He had a van and would pretend to do a three point turn and ram the poor little tree each time he got the chance. Finally with all the other trees gone, the passing dogs had only one tree marker left. Their piddle combined with the weakened and cracked tree trunk, and it wasn't long before a blustery wind brought down this little, harmless tree.

I did ask and was assured that the tree would be replaced. It never was.
