Harringay, Haringey - So Good they Spelt it Twice!

At the last Area Assembly Councillor Canver mentioned a solution to clearing problem rubbish in neighbours' front gardens. I contacted her afterwards and asked if she might provide additional details. I have just received her reply including a response from the the appropriate council officer, which I have reproduced below:

Local Authorities have the power to issue several types of Statutory Notice requiring land owners or occupiers of land to clear any build up of waste or anything else that is either harmful to human health, Nuisance, detrimental to the local amenity or providing harbourage for rats and mice. These circumstances are judged by authorised officers by way of a visit to the location. Quite often, issues such as these can be solved by negotiation but authorised officers can serve notice at any time and require the owner/occupier to carry out work, which is reasonable, to improve the area. If the owner/occupier fails to carry out the work, they are in breach on the notice and can be prosecuted and fined for this breach.

The Council, in these circumstances, would usually carry out necessary work in default and charge the owner/occupier for this work. These Notices can be a very effective way in clearing land but can take some time in achieving the required result. Owner/occupiers have a right of appeal to a magistrate if they believe the Notice is unfair or drafted incorrectly. Notices, once served, must by law give the recipient time to carry out the work required, usually 28 days from the serving of the Notice.

Haringey Council is very proactive in the use of Statutory Notices as a tool to encourage compliance of the law, in the current financial year to date, 2,974 Statutory Notices have been served concerning land, environmental crime, food safety and a range of other statutory functions carried out by the Enforcement Service.

The legislation used mostly in connection with the service of notices is;

· Environmental Protection Act 1990

· Town and Country Planning Act 1990

· Prevention of Damage by Pests Act 1949

I'm against us dealing with McDonald's security issues but I think those of us that can do need to go out on a limb once in a while. Last night I was talking to a friend on the phone while I was going down the passage to pick up my curry and what should I hear behind me but a bloody moped. Needless to say I gave him a piece of my mind (what can he do when he has that moped to look after) and yelled his rego number at him. T425 TUJ (not 100% about the last bit).

On Friday night my wife was taking our daughter out to Pinocchio at Sadler's Wells and had to use a cash machine at Angel. There was one queue for three machines but one young lady decided to take the piss and when she was prevented from doing so by my wife had a fit. When she got the next machine she threatend her with "you know, if you didn't have a kid with you, I'd bash you." Nice.

I think from the awful bollocks that Annette is suffering from it's worth a bit of attitude to just ask them to move the mattresses over the wall - OR if they'd mind if someone else did it. Just be firm and polite and don't be scared.

Our ASBO/HMO house in Lausanne Rd was number 45. It stopped being so bad once the landlord (not the agent) found out what was going on. Might be an idea to involve them too.
John, I don't disagree but not everyone is capable of 'a bit of attitude' and what I'm objecting to is the idea that it is easy to confront or follow up...'just phone up, just have a word'.
I've been threatened with violence on more than one occasion for reminding people of their social obligations including a time when a punch was coming my way and the only thing that saved me was the bus door closing...over a piece of litter (not even his!). I'm not an exceptionally brave person and I understand how some people could simply not do this. Perhaps the Community Volunteer scheme that Hugh posted about could help, those who feel able, help out those who cannot deal with it.

Hi Margaret, try calling 0208 489 5230 and tell them it's dumped rubbish. Chances are they'll remove it. Good luck!
i am interested to see Lime Light properties mentioned. they have an HMO in my road that is run as a bed and breakfast whoch means they deliver food a few times a week, is it legal? do the council know. the house in my road never had planning permission to be an HMO but it is still run as one. anyone any ideas?

Hi Anna, they own and run the house from hell opposite me now. Have a look at my blog to see what we're having to deal with. I don't know if it's legal or not, but I suggest you contact the housing sector at Haringey council. I contacted the local police years ago when I first started complaining about this house, and they knew Limelight well. They run s**tholes (sorry, I'm FED UP!) like this all over North London, a lot of them problem properties. Nice, eh? If you have problems with this house I sugest you call the safer neighbourhoods team, they have been abolutely fantastic in my experience.
The house opposite me never had planning permission either, but was converted without permission in -93, and if it's been undetedetcted for over 4 years then they've basically gotten away with it, and can happily keep on filling the house up with people who ruin the quality of life for the rest of us. I am absolutely disgusted with it, and I would love to know how many times they've willingly pulled this one off, and if there's a solicitor on this site that would be willing to look into it and take them to task.

You should also find out who places people in there, and if the house is in line with health and safety as well as fire regulations. If it's not then Limelight will have to do something. Does your HMO hav doorbells? That's one of the things that's driving me up the wall with our one.
The enforcement at 0208 489 5230 will serve notice on the landlords of HMOs. I called Mr. Cooke at the aforementioned number about the HMO next door, not the first time. He called me back 2 days later to say that he'd been to the address, seen the cause of my concern, and duely served a notice on the landlords. They then have 28 days to respond either to clear it up or to appeal. What with the post 'n that, it was cleared within a week.
This isn't the first time I've resorted to the council's enforcement team over the particular property. I've given up trying to resolve these matters directly with the landlord, and the council are good at following these reports up. They will give you an incident ref. number so you can follow it up at any time you need to.
I really don't recommend trying to resolve these matters with the inhabitants, or anybody outside of the authorities. Use the enforcement services, they might get fed up with coming down here, and hopefully stop turning a blind eye to the situation. Get it on record, those statistics will come in useful sometime.

I didn't ever get the info Sarah, no. An email trail asking ultimately if my info could be passed to Robin Payne, Head of Enforcement. So I guess he's the guy. I'm sure Liz will have his number. I'll ask her.
A colleague who I'm working with at the moment forwarded me an article about an approach that Barking and Dagneham Council have taken to deal with this problem.

Using community collaboration and the threat of legal action against landlords, the Eyesore Gardens initiative has apparently been very successful.

I'll forward the link to Cllr Canver and see if I can't get that number which seems to have fallen between the cracks. (It may be that I've received it and forgotten to post it on here.)
