Harringay, Haringey - So Good they Spelt it Twice!

Hello everyone,

Does anyone have any advice on which is the best governing body that might regulate or govern leaseholders?  I am a leaseholder living in a terraced house with two other leaseholders. One of the leaseholders is an estate agent.  They are inert and dodgy and are not fulfilling their share of responsibility re repairs etc.  Or any organisation that can regulate landlords? Please help! Any advice welcome!

Depending on the nature of the repairs, will decide who is responsible for organising them.  Anything internal to your flat, you would be responsible for organising but if the repairs relate to the building structure or shared parts of the building then the freeholder must organise (not pay for, but organise).

If the freeholder does not organise the repairs in a reasonable time, he is in breach of your lease (I would send him a letter detailing the issues or required works asking him to respond within 14 days).  He can not use the fact that one leaseholder won't pay as an excuse, simply put, that is "his problem" as that leaseholder is then breaching his lease with the freeholder (and the freeholder can pursue him through the courts).

If your freeholder still refuses, there is little you can do other than seek formal advice and make a claim through the courts (hopefully small claims would do the trick).  Freeholders are pretty much unregulated unfortunately so there is no body that can really help.

That said, I'm sure your Citizens Advice Bureau would happily help you write a legal sounds letter.

Contact the Leasehold Advisory Service in the first instance. They can be very helpful.

I've had experience of both and may be able to advise further if you send me some details, but try the advisory service first. They have solicitors on hand who give free advice and some of them are very good.

As already mentioned Lease Advisory Service is the best place to start but if you do need to take it further there are local solicitors that can help with this.

I'd talk with the LKP (Leasehold Knowledge Partnership) folks. or at least have a read of the very informative material on their website.
