Harringay, Haringey - So Good they Spelt it Twice!

Hi I appealed a PCN I received on Jan 14th on the same day I received it (now 7 weeks ago) and haven't heard back yet. I can't find anywhere on the council website where you can email in a situation like this. I sent an email to: parking@haringey.gov.uk    about 10 days ago but still nothing. I don't know if leaving it is a good idea in case the council say they emailed me and if I lose the appeal I'll need to pay the full amount, I'm confident I won't, not least because of my appeal reasons are completely valid plus on closer inspection I noticed that the road named on the PCN is not the one I was parked in!! I'm guessing that the lack of communication is down to them realising their mistake but I still can't be sure so wondered if anyone has any ideas on what I could do next? Many Thanks

One option would be to ask one of your councillors to intervene for you. They tend to be relatively experienced in getting a response on residents' behalf.

There are different stages to the process, Glen. Starting with a "challenge" and ending with a formal appeal to PATAS - the London-wide Parking and Traffic Appeals Service. It sounds like you're at the first stage. Haringey Parking Service have tried to make this clearer on the Council's website.

If you've used this procedure you'll have seen that it includes the following information here:

Once we receive your challenge

We will aim to write to you with our decision within 28 days of receiving your challenge. All actions on the notice will be suspended until a full reply has been sent. If you have to pay we will give you a further 14 days at the discounted rate.

As the 28 days have long gone without you getting a full reply, then - if Haringey correctly follows its own procedure - action on your PCN should still be suspended. But plainly you don't want or need the continuing uncertainly. And certainly not complete silence!

From what you wrote, it seems that since you challenged the PCN you've spotted another flaw - they named the wrong road. If you haven't already done so, I'd suggest you email again pointing out this extra information.

Where do you go next? I'd suggest you email Cllr Nilgun Canver the "cabinet" councillor who has parking within her remit. Copying in your own ward councillors if you live in Haringey. (You can get their names and contact details by typing your postcode into the search box on this webpage.)

The parking department didn't reply to my emails either. They were however good when i phoned them via the council telephone number.

I've had this happen, and according to the Road Traffic Act (1991), if you have not had any response to your appeal within 56 days, the PCN is automatically voided (see http://www.legislation.gov.uk/ukpga/1991/40/section/71, sections 6 & 9). When you sent your initial e-mail appeal, did you get an automatic e-mail receipt?

I challenged one and it took forever for them to come back to me. Think they say they will respond within 90 days - it defo says on their website the time frame.
