I thought I would post a new thread in case anyone missed it.</p>
<p>This is an application to extend a 6-person HMO with a history of antisocial behaviour to 10 people.</p>
<p>I am concerned it is an overdevelopment because of:</p>
<p>Increased intensity of use/ occupation density leading to unsustainable increases in noise, pressures on traffic/parking on the road, refuse collection, plumbing/drains, loss of light to neighbouring properties amongst other things.</p>

<p>Now I don't want to interfere with anybody's plans, but I can't help feeling that gardens are not houses for a reason, and exist for people to have a bit of outside space, for wildlife, providing drainage for rainwater (esp. in conditions where climate change is likely to cause more frequent flooding) etc. Looking up the <a href="http://www.planningservices.haringey.gov.uk/portal/servlets/ApplicationSearchServlet?PKID=413382" target="_blank" rel="noopener">application online</a>, I also noticed that the people applying for it are not the ones living at the address. So it does look a bit like it might be an attempt by a landlord to cram in as many people as possible into a space that hasn't been constructed for it. It just generally doesn't strike me as a brilliant idea.</p>
<p>Anyway. Does anybody else have views on this, and what is the best thing to do? I do feel like I probably want to object, but would also like some opinions first, as well as what would be the best grounds on which to do so.</p>

<li>Excessive noise from 9 occupants through shared walls and in garden, infringing on those neighbouring residents' right to the quiet enjoyment of their home</li>
<li>Excessive waste from 9 occupants which leads to overflowing bins and attracts vermin (plans show bins to be put on pavement)</li>
<li><span style="font-weight: 400;">There is already a high concentration of HMOs elsewhere on the road and immediate area. Therefore, to grant this application would be a breach of Policy DM17</span></li>

<p>Changes have come into effect that <a href="https://www.haringey.gov.uk/housing/landlords/houses-multiple-occupation/hmo-licensing/hmo-licensing-changes" target="_blank" rel="noopener">extend enforcement of a licensing scheme</a> for larger rented properties. The scheme is designed to target "HMOs" and ensure landlords maintain certain standards in relation to the quality and safety of their properties. However the additional licencing the council have chosen to enforce also capture what may would traditionally see as 'shared houses', ie that might have young professionals or students sharing. </p>
<p>The Haringey web site is a bit tricky to navigate to get chapter and verse, but broadly the criteria now in force will cover any property that meets the following criteria:</p>
<ul>
<li>HMOs occupied by five persons or more in two or more households, regardless of the number of storeys</li>
<li>Purpose built flats where there are up to two flats in the block and one or both are occupied as an HMO</li>
</ul>
<p>The number of people in an HMO is described differently in a <a href="https://www.haringey.gov.uk/sites/haringeygovuk/files/property_licensing_-_1._different_types_of_property_licensing.pdf" target="_blank" rel="noopener">stand alone piece of guidance</a> from Haringey as 3 people in two or more households who may share toilet/ bathroom/ kitchen facilities... This is in relation to the extended licensing scheme the council are implementing too. The <a href="https://www.haringey.gov.uk/sites/haringeygovuk/files/property_licensing_-_12._maps_of_the_29_selective_licensing_areas.pdf" target="_blank" rel="noopener">map showing what streets are covered</a> in this selective extended scheme shows a lot of streets locally are covered.</p>
<p>If landlords do not have a licence it will be an offence to operate an HMO from 1 October 2018. They can be:</p>
<ul>
<li>Prosecuted and if found guilty be liable to an unlimited fine</li>
<li>Incur a Civil Penalty Notice for failing to licence which can impose a fine of up to £30,000</li>
<li>Also have their licence period shortened</li>
</ul>
<p><a href="https://www.haringey.gov.uk/housing/landlords/multiple-occupants/hmo-licensing-register" target="_blank" rel="noopener">You can check</a> if a property near you that you may have concerns about is already covered by the scheme- ie, the landlord actually has a license.</p>
<p>What is interesting about this is that there may be a real tool to enforce certain standards of behavior on landlords through the threat to withdraw their license. So landlords can be chased who persistently have their properties looking like a hovel, or who leave and dump rubbish on the streets etc. This could actually be a really useful tool in having landlords treat their tenants well and drive them towards being responsible neighbours.</p>

A fair few roads on The Ladder and in The Gardens are not included and some only partially so (for instance the north side of Mattison is in but the south side isn’t). As far as I can gather the proposals are based on the last census (which showed where HMOs were located) and crime statistics.</p>

<p>we've got ongoing issues with our neighbours who run the house next to us as 'slum landlords' and do rogue building activities.</p>

<p>Basically they're running an illegal sharehouse next to us that was at most occupying up to 17 people in a 4 bedroom house.</p>
<p><strong>What we discovered now is that the owner</strong> (who's apparently a property magnate owning about 40-50 houses in North London) <strong>is increasing the size of an outbuilding to bigger than agreed.</strong> The certificate of lawfulness should allow him to increase it to about double the size, however he seems to build to triple the size. What he declares to be a 'gym and games room' is rather a one bedroom flat with a huge foundation and running water.</p>
<p>So far he's very much neglected all rules and regulations of building law, e.g. he tore a wall down right next to our house and made a hole in our kitchen wall claiming it is his. He only agreed to get a survey done when we went to court requesting an injunction.</p>
<p><strong>Has anyone come across a similar case?</strong> We've been onto several council departments due to various problems, but they surprisingly turn a very blind eye on the case. There were only controls when we and other neighbours reported an issue and continued banging on about it literally for months until they took action. However even this didn't bring any solution (e.g. we were reassured that the house would be vacated by end of May but there's still people living in there.)</p>
<p>Any advice is much appreciated - obviously we will report the issue to the council again but we're just wondering how to best deal with it and what action the council is most likely going to take.</p>
